Affärsadvokaterna has broad experience in both contract negotiations and in drafting procurement documentation and tenders – for both public and private procurements. We help clients identify challenges early on and propose practical, business-oriented solutions.

We work proactively throughout the project and make sure to fully understand the client’s specific conditions from the outset – which is key to delivering efficient and targeted results.

With our project management experience, we present clear plans for how the procurement process should be structured, governed, and followed up – including key factors, costs, and risks.

Examples of assignments:

  • Advised a leading international IT company in reviewing and evaluating two major procurement processes (PCs and consulting services), both of which the company won.
  • Regularly advised one of Sweden’s largest contracting authorities on its procurement procedures and all related legal matters.
  • Assisted one of the world’s largest management and IT consultancy firms in multiple public and private procurements. The assignment included complex contract review and negotiation, drafting of agreements and correspondence, project management, and other related legal advice.
  • Supported a Swedish company in several public and private procurements, involving complex contract review, negotiations, drafting, and legal strategy.
  • Advised an identity security services company in drafting, negotiating, and reviewing a back-to-back agreement related to a public procurement in which the client acted as a subcontractor.
  • Assisted a leading international packaging company – offering sustainable, plastic-free packaging, recycling services, and paper products – in procuring a warehouse management system from a Swedish SaaS provider, for use across its facilities in Sweden and elsewhere.
  • Supported a leading international IT company in evaluating outsourcing procurements related to PC-as-a-Service, service desk, server and application operations (approx. SEK 700 million), project management, WAN operation, and systems development.
  • Advised a major transport group in the review, preparation, and evaluation of SL’s commuter train procurement in Stockholm (approx. SEK 7 billion) and the national procurement of long-distance rail traffic in northern Sweden (approx. SEK 2 billion), both of which were awarded to group companies. Also handled all legal and strategic matters related to the establishment of subsidiaries formed for each procurement, including drafting and negotiation of all related agreements.
  • Reviewed and evaluated the SEK 11 billion joint procurement by Skånetrafiken (Sweden) and Trafikstyrelsen (Denmark) for rail traffic in southern Sweden and Denmark. Mattias Lindberg represented the leading transport group that formed a joint venture with a Hong Kong-based company. All legal and strategic matters relating to the procurement, corporate and shareholder issues, and litigation were managed – including the joint venture’s request for review in Swedish and Danish courts, challenging DSB’s winning bid on grounds of unlawful state aid and procurement law violations. The case also addressed the right to access bid documents deemed confidential by the courts.
